A total of six companies are to be penalized for anti-competitive price agreements, coordinated offers, and illegal information exchange with competitors. The violations concern tenders in the field of building construction in Burgenland.

Over 800,000 Euros in Penalty Requests

The BWB announced on Tuesday that the companies involved are so-called "secondary participants." According to the authority, their involvement in the cartel was of lesser intensity, and they cooperated with the investigative authorities.

The penalty requests are specifically directed at:

  • Eibel Bau GmbH: 26.000 Euro
  • Gartner-Schiener Bau GesmbH: 115.000 Euro
  • Dipl. Ing. Adalbert Kienzl Baugesellschaft m.b.H. & Co. KG sowie m.b.H.: 45.000 Euro
  • Neumayer BAU Ges.m.b.H. Pfnier & Co GmbH: 495.000 Euro
  • Schwartz Bauunternehmen GmbH: 140.000 Euro

The requested fines thus amount to a total of approximately 821,000 euros.

Cartel Proceedings Continue to Expand

The construction cartel, which was uncovered a few years ago, is one of the largest competition proceedings in Austria.
